StreamKite Terms & Conditions — Version 2.0
These Terms constitute a legally binding agreement between you ("User", "Customer") and StreamKite ("we", "us", "our") as operator of StreamKite.live. Effective from April 1, 2026. By accessing or using any part of the StreamKite platform, you confirm you have read, understood, and agree to be bound by these Terms in full.

Section 01  ·  Legal Foundation
Acceptance of Terms

By purchasing a plan, activating a PassKey, using the StreamKite dashboard, uploading media, or accessing any part of StreamKite.live or its associated APIs, you agree to be fully bound by these Terms and Conditions, our Privacy Policy, and our Refund Policy.

If you do not agree to any part of these Terms, you must immediately cease all use of the StreamKite platform and services. These Terms constitute the entire agreement between you and StreamKite concerning your use of the service and supersede all prior agreements or understandings, oral or written.

Minors: You must be at least 18 years of age (or the age of legal majority in your jurisdiction, whichever is greater) to use StreamKite. By using our service, you represent and warrant that you meet this age requirement. If you are using StreamKite on behalf of a business entity, you represent that you have authority to bind that entity to these Terms.

Section 02  ·  Service Definition
Description of Service

StreamKite is a cloud-based live streaming infrastructure service that enables users to broadcast pre-uploaded media files to compatible third-party platforms (including but not limited to YouTube, Twitch, Facebook Live, and any custom RTMP endpoint) on a continuous basis using the RTMP protocol.

What StreamKite Provides

  • Cloud server hosting and process management for streaming slots
  • A web-based dashboard for managing stream slots, uploading media, and monitoring stream status
  • Automated stream engine based crash recovery and stream restart functionality
  • Scheduling, playlist management, and bulk control tools
  • Encrypted media file storage for the duration of the subscription
  • PassKey-based authentication system providing dashboard access
  • Addon slot plans purchasable independently of core plans
  • Real-time analytics including stream health and uptime data

What StreamKite Does Not Provide

  • Ownership of, or responsibility for, the destination streaming platforms (YouTube, Twitch, Facebook, etc.)
  • Guarantee that destination platforms will accept or continue to accept your stream
  • Legal advice, tax guidance, or compliance consultation of any kind
  • Content creation, editing, or production services
  • Monitoring or moderation of streamed content

StreamKite functions as a transmission infrastructure service only. We transmit your uploaded media to destinations you specify. We are not a broadcast network, publisher, or content provider. All content responsibility remains entirely with you.

Section 03  ·  User Responsibility
PassKey & Account Access

StreamKite uses a PassKey-based authentication system. Instead of a traditional username and password, you are assigned a unique PassKey upon purchase. This PassKey serves as your sole credential to access the StreamKite dashboard and manage your account.

Your Responsibilities

  • You are solely responsible for maintaining the confidentiality and security of your PassKey
  • You are responsible for all activity that occurs under your PassKey, whether or not you authorised it
  • You must notify us immediately via our support system if you suspect your PassKey has been compromised, stolen, or misused
  • You must not sell, transfer, rent, or sub-license your PassKey to third parties for commercial resale without our express written consent
  • You must not publish your PassKey publicly

Important: StreamKite cannot verify the identity of a person using a valid PassKey. If your PassKey is shared or compromised, StreamKite bears no liability for any misuse, data loss, or service degradation that results. You assume full responsibility for all actions taken using your PassKey.

StreamKite reserves the right to invalidate a PassKey suspected of being misused, shared in violation of these Terms, or associated with policy violations — without prior notice and without any obligation to issue a refund.

Section 04  ·  Platform Policy
Acceptable Use Policy

You agree to use StreamKite only for lawful purposes and in a manner consistent with all applicable local, national, and international laws and regulations. You are responsible for ensuring that your use of the service complies with the laws of your country and the terms of service of the destination platforms you broadcast to.

Permitted Use

  • Broadcasting original content you own or have full rights to distribute
  • Streaming royalty-free, Creative Commons, or licensed media you are authorised to broadcast
  • Operating 24/7 channels, looping channels, playlist channels, or event-based streams using your own content
  • Using StreamKite for personal, business, educational, or creative broadcasting purposes
  • Reselling streaming services to clients using your own PassKey, within the slot limits of your plan

Prohibited Use

  • Using StreamKite to evade, circumvent, or disrupt any third-party platform's terms of service or access controls
  • Attempting to reverse-engineer, decompile, or exploit the StreamKite platform, servers, or infrastructure
  • Using automated bots, scripts, or tools to abuse the dashboard, API endpoints, or upload system
  • Creating multiple accounts or PassKeys to circumvent plan limits without authorisation
  • Interfering with the access or experience of other StreamKite users or the stability of shared server infrastructure

Immediate Termination Risk: Violations of this Acceptable Use Policy may result in your service being suspended or permanently terminated, without refund, and without prior notice. We reserve the right to determine, in our sole and reasonable discretion, whether a violation has occurred.

Section 05  ·  High Risk
Prohibited Content

You must not use StreamKite to stream, upload, transmit, or broadcast any content that falls within the following categories. These prohibitions are absolute — there are no exceptions based on intent, context, or claimed purpose.

Copyright InfringementCopyrighted music, videos, films, TV shows, sports broadcasts, or any media you do not own or hold a valid broadcast licence for. This explicitly includes background music in streams.
Illegal ContentAny content that violates any applicable law, including content that promotes, facilitates, or depicts criminal activity.
Hate & HarmContent that promotes hatred, violence, discrimination, or harassment based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic.
Adult & ExplicitPornographic, sexually explicit, or obscene material of any kind. StreamKite is not licensed for adult content distribution.
Terrorism & ExtremismContent that promotes, glorifies, or facilitates terrorism, extremist ideology, or political violence.
Fraud & DeceptionContent designed to deceive, defraud, or manipulate viewers, including investment fraud, phishing content, or false advertising.
Privacy ViolationsContent that reveals private personal information about individuals without their consent, including doxxing or non-consensual intimate imagery.
Malware & ExploitsFiles containing malicious code, viruses, ransomware, or content designed to compromise viewer devices or systems.

Copyright Notice: Streaming copyrighted music or video content without a valid licence is an especially common violation that can result in both your StreamKite account being terminated and legal action by the rights holder against you directly. StreamKite does not indemnify you against any intellectual property claims.

Section 06  ·  User Responsibility
Content Responsibility

You are solely and exclusively responsible for all media files you upload to StreamKite, all stream keys you configure, all destinations you broadcast to, and all content you transmit through the platform.

By uploading content to StreamKite, you represent, warrant, and covenant that:

  • You are the original creator of the content, or you hold all necessary rights, licences, and permissions required to upload, store, and broadcast the content via RTMP to the configured platforms
  • The content does not infringe any third party's intellectual property rights, privacy rights, publicity rights, or any other legal rights
  • The content complies with all applicable laws and regulations in your jurisdiction and in the jurisdictions of your viewers
  • The content does not violate the terms of service of any destination platform (YouTube, Twitch, Facebook, etc.) you are broadcasting to
  • You have obtained all necessary permissions, releases, or consents from any individuals depicted in or associated with the content

StreamKite operates as a passive transmission conduit only. We do not proactively monitor, screen, review, or moderate uploaded content. However, we reserve the right — but not the obligation — to remove content or suspend service if we become aware of a violation of these Terms.

ℹ️

StreamKite's role is analogous to that of an internet service provider in terms of content neutrality. We transmit what you upload. All liability for that content rests with you.

Section 07  ·  Commercial Terms
Subscription & Payment

Plan Structure

StreamKite subscriptions are prepaid for a fixed validity period — either 30 days (monthly) or 365 days (annual). Subscriptions are activated immediately upon successful payment verification and PassKey delivery.

Payments

  • All payments are processed through our third-party checkout provider (Payhip or similar). StreamKite does not store your payment card details
  • Prices are displayed in US Dollars (USD) and are inclusive of any applicable service fees unless otherwise stated
  • We reserve the right to update pricing at any time. Price changes will not affect active subscriptions already purchased
  • Payments are non-transferable between PassKeys or accounts

No Auto-Renewal

StreamKite subscriptions do not automatically renew. Your subscription expires at the end of the validity period without any further charge. You are responsible for renewing your plan if you wish to continue using the service. We provide a 7-day courtesy reminder notification prior to expiry; however, non-receipt of this reminder does not extend your subscription or entitle you to a refund.

Addon Plans

Addon slot plans are billed separately from your core plan and have their own independent validity period. Addon plans are also non-auto-renewing. Expiry of your core plan does not automatically cancel your addon plan and vice versa — both are managed independently.

Renew Key System: To renew your service, you purchase a Renew Key from our shop and apply it in your dashboard. This design means you are never unexpectedly charged. All renewals are explicit, intentional, and user-initiated.

Grace Period

Upon expiry of a subscription, StreamKite provides a 3-day grace period during which your dashboard remains accessible in read-only mode and your media files are preserved. After the grace period expires without renewal, your streaming slots will be deactivated and your media files will be permanently deleted from our servers. This deletion is irreversible.

Section 08  ·  Policy
Refund Policy

Due to the immediate digital nature of our service — PassKeys are delivered and activated instantly upon payment — StreamKite operates under a strictly limited refund policy.

Refunds Will Not Be Issued For

  • Change of mind after purchase or activation
  • Inability to set up or configure your stream due to user error
  • Destination platform restrictions, bans, or suspensions affecting your stream key (these are outside StreamKite's control)
  • Partial use of a subscription period — unused days are non-refundable
  • Termination of service due to violation of these Terms
  • Failure to renew before expiry resulting in data deletion
  • Internet connectivity issues on your end or on the destination platform's end

When Refunds May Be Considered

  • Service has been completely unavailable for more than 72 consecutive hours due to fault on StreamKite's infrastructure (not third-party platforms)
  • Technical failure resulted in a PassKey being delivered that does not function, and the issue cannot be resolved by our support team within 48 hours
  • Duplicate payment for the same plan within the same billing cycle, where both charges are verified

All refund requests must be submitted via our support ticket system within 7 days of the original purchase date. Refund decisions are made at StreamKite's sole discretion and are final. For our full refund policy, please visit our Refund Policy page.

Section 09  ·  SLA & Uptime
Service Availability & Uptime

StreamKite targets a 99.9% uptime rate for its streaming infrastructure. This represents our operational commitment and is not a contractual guarantee of any specific compensation for downtime unless otherwise stated in a specific Service Level Agreement.

Planned Maintenance

StreamKite may take the service offline for scheduled maintenance, upgrades, or infrastructure changes. We will endeavour to provide advance notice of planned maintenance periods where possible. Maintenance is typically performed during low-traffic periods.

Unplanned Outages

In the event of an unplanned outage, StreamKite will work to restore service as quickly as reasonably possible. StreamKite is not liable for interruptions resulting from:

  • Force majeure events including but not limited to natural disasters, war, civil unrest, government action, or pandemic
  • Failures of third-party infrastructure providers including cloud hosting, CDN, or DNS services
  • Internet connectivity failures upstream of StreamKite's servers
  • Actions by destination platforms (YouTube, Twitch, Facebook) that affect RTMP stream acceptance
  • DDoS attacks or other malicious interference targeting StreamKite's servers
  • Actions caused by violation of these Terms by you or other users

StreamKite's smart engine based crash recovery system is designed to automatically restart crashed streams within seconds. However, this system operates within the constraints of the underlying server and network infrastructure and cannot guarantee recovery in all circumstances, particularly during server-level outages.

Section 10  ·  Risk
Termination

Termination by StreamKite

StreamKite reserves the right to immediately suspend or permanently terminate your access to the service, including invalidating your PassKey, with or without prior notice and without obligation to issue any refund, in any of the following circumstances:

  • Breach of any provision of these Terms and Conditions
  • Violation of the Acceptable Use Policy or Prohibited Content provisions
  • Uploading or streaming content that exposes StreamKite to legal liability or reputational harm
  • Abuse of our support system, including harassment of support staff
  • Attempting to compromise the security, integrity, or availability of the StreamKite platform
  • Non-payment, charge-back, or payment fraud
  • Court order, legal obligation, or regulatory direction requiring suspension

Termination by You

You may discontinue use of StreamKite at any time by simply not renewing your subscription. No action is required to "cancel" — your access will automatically cease at the end of your validity period. You may also request immediate account deletion by contacting our support team; note that this will result in permanent deletion of all your media files and slot data.

Effect of Termination

  • All active streams will be stopped immediately upon termination
  • Your PassKey will be invalidated and dashboard access will cease
  • All uploaded media files and slot configurations will be permanently deleted
  • No refund will be issued for any remaining subscription period
  • Any outstanding obligations you have to StreamKite survive termination

Section 11  ·  Legal Protection
Limitation of Liability

To the maximum extent permitted under applicable law, StreamKite's total aggregate liability to you arising out of or in connection with your use of the service — whether in contract, tort (including negligence), breach of statutory duty, or otherwise — shall not exceed the total amount paid by you to StreamKite in the thirty (30) days immediately preceding the event giving rise to the claim.

Excluded Damages

In no event shall StreamKite, its directors, employees, agents, partners, or licensors be liable for any:

  • Loss of revenue, profit, or income
  • Loss of business, contracts, or commercial opportunities
  • Loss of anticipated savings
  • Loss of data or content (including media files)
  • Business interruption
  • Loss of goodwill or reputation
  • Indirect, incidental, special, consequential, punitive, or exemplary damages
  • Damages arising from third-party platform decisions, including stream termination by YouTube, Twitch, or Facebook

These exclusions apply whether or not StreamKite has been advised of the possibility of such damages and regardless of the legal theory under which liability is sought.

Some jurisdictions do not permit the exclusion of certain warranties or limitation of liability for certain types of damage. In such jurisdictions, StreamKite's liability will be limited to the maximum extent permitted by applicable law. Nothing in these Terms excludes liability for fraud, gross negligence, or death or personal injury caused by StreamKite's negligence.

Disclaimer of Warranties

THE STREAMKITE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW.

StreamKite expressly disclaims all warranties, including but not limited to:

  • Implied warranties of merchantability and fitness for a particular purpose
  • Warranties that the service will be uninterrupted, error-free, or free from harmful components
  • Warranties regarding the accuracy, reliability, or completeness of any content, data, or analytics provided by the service
  • Warranties that the service will meet your specific requirements or expectations
  • Warranties that defects in the service will be corrected within any specific timeframe
  • Warranties regarding the performance of third-party streaming platforms connected via RTMP

Any advice, information, or data obtained from StreamKite or through the service — whether from support staff, documentation, or any other source — does not create any warranty not expressly stated in these Terms.

Section 13  ·  Ownership
Intellectual Property

All intellectual property rights in and to the StreamKite platform, including the dashboard software, user interface design, branding, logos, trademarks, documentation, PassKey system architecture, and any related proprietary technology, are owned by or exclusively licensed to StreamKite.

Nothing in these Terms grants you any right, title, or interest in StreamKite's intellectual property except the limited right to use the service as expressly provided in these Terms. Specifically, you may not:

  • Copy, reproduce, or create derivative works based on any part of the StreamKite platform or its code
  • Use StreamKite's trademarks, brand name, or logo without express written permission
  • Reverse engineer, decompile, disassemble, or attempt to derive source code from the StreamKite platform
  • Remove or alter any copyright, trademark, or other proprietary notices in the service
  • Build a competing service using knowledge gained from access to StreamKite

Your Content

You retain all intellectual property rights in the media files you upload to StreamKite. By uploading content, you grant StreamKite a limited, non-exclusive, royalty-free licence to store, transmit, and process your content solely for the purpose of delivering the service to you. This licence terminates upon deletion of your content or expiry of your subscription.

Section 14  ·  External Services
Third-Party Platforms & Services

StreamKite transmits your content to third-party streaming platforms (such as YouTube, Twitch, Facebook Live, TikTok Live, and others) using RTMP stream keys that you provide. StreamKite has no relationship with, authority over, or responsibility for these platforms.

Platform Independence

  • StreamKite is not affiliated with, endorsed by, or a partner of YouTube, Twitch, Facebook, or any other destination platform
  • Your eligibility to stream on any destination platform is governed exclusively by that platform's own terms of service
  • StreamKite is not responsible if a destination platform suspends, bans, or terminates your stream key or account
  • Changes to a destination platform's RTMP endpoint, stream key format, or API may affect service functionality, and StreamKite bears no liability for such changes
  • StreamKite cannot guarantee that streams transmitted to third-party platforms will be accepted, processed, or displayed correctly by those platforms

Payment Processor

Payment processing is handled by a third-party checkout provider. StreamKite does not store payment card information. Your payment data is subject to the privacy policy and terms of the payment processor, not StreamKite. StreamKite is not liable for errors, failures, or data breaches occurring at the payment processor.

ℹ️

If your stream key is revoked or your account is banned by a destination platform, this does not entitle you to a refund from StreamKite. The StreamKite service (the streaming infrastructure) remains fully operational — the destination platform's decision is entirely outside our control.

Section 15  ·  Legal Protection
Indemnification

You agree to indemnify, defend, and hold harmless StreamKite, its officers, directors, employees, agents, contractors, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable legal fees) arising out of or relating to:

  • Your violation of these Terms and Conditions
  • Your violation of any applicable law or regulation
  • Content you upload, stream, or transmit through the StreamKite platform
  • Your violation of any third party's intellectual property rights, privacy rights, or other rights
  • Your violation of the terms of service of any destination streaming platform
  • Any claim by a third party that your content or use of the service caused them harm
  • Misuse of your PassKey by any person, including persons to whom you have voluntarily given access

StreamKite reserves the right, at your expense, to assume exclusive defence and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defence of such claims. You agree not to settle any matter without StreamKite's prior written consent.

Section 16  ·  User Rights
Privacy & Data

Your privacy is important to us. The collection, use, and protection of your personal data is governed by our Privacy Policy, which is incorporated into and forms part of these Terms. By using StreamKite, you also agree to the terms of our Privacy Policy.

Key Data Commitments

  • We do not sell your personal data to third parties
  • Your uploaded media files are stored on encrypted server paths inaccessible to the public
  • We collect only the minimum data necessary to operate the service (email address if voluntarily provided, usage analytics, server logs)
  • Media files and slot data are permanently deleted upon subscription expiry (after the grace period) or upon request
  • We use your email address only to send service-critical communications (PassKey delivery, renewal reminders, support responses)

StreamKite is designed with a privacy-first approach. Our PassKey system means we never store passwords. Our dashboard requires minimal personal information to operate. For full details, see our Privacy Policy.

Section 17  ·  Policy
Changes to These Terms

StreamKite reserves the right to modify, update, or replace these Terms at any time. We will provide reasonable advance notice of material changes where possible, which may be delivered through:

  • A notification displayed prominently on the StreamKite website or dashboard
  • An email to the address associated with your account (if you have registered one)
  • An update to the "Last Updated" date at the top of this page

Your continued use of the StreamKite service after any modification to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the service prior to the effective date of the changes.

We encourage you to review these Terms periodically. Material changes that substantially alter your rights or obligations will be identified as such in the notification.

Section 18  ·  Jurisdiction
Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflicts of law principles that would result in the application of the laws of another jurisdiction.

Dispute Resolution Process

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the StreamKite service, the parties agree to the following resolution process:

  • Step 1 — Good Faith Negotiation: You must first contact StreamKite through our support ticket system and attempt to resolve the dispute through direct communication in good faith. Most issues can be resolved this way.
  • Step 2 — Mediation: If direct negotiation fails within 30 days, either party may request non-binding mediation through a mutually agreed mediator.
  • Step 3 — Binding Arbitration or Litigation: If mediation is unsuccessful, disputes may be submitted to binding arbitration or, where arbitration is not enforceable, to the courts of competent jurisdiction.

Class Action Waiver: To the extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted on an individual basis only, and not as part of a class, consolidated, or representative action.

Section 19  ·  Legal Mechanics
Severability, Waiver & Entire Agreement

Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, the provision shall be severed from these Terms. The remaining provisions of these Terms will continue in full force and effect.

Waiver

StreamKite's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorised representative of StreamKite to be effective. A waiver of any breach does not constitute a waiver of any subsequent breach.

Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, and any other policies incorporated herein by reference, constitute the entire and exclusive agreement between you and StreamKite relating to your use of the service. They supersede all prior and contemporaneous agreements, representations, and understandings of any kind.

Assignment

You may not assign or transfer these Terms or any rights under these Terms without StreamKite's prior written consent. StreamKite may freely assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law.
