General Disclaimer

This Disclaimer forms part of StreamKite's legal framework alongside our Terms & Conditions, Privacy Policy, Refund Policy, and DMCA Policy. Together these documents constitute the complete agreement governing your use of StreamKite.live and all associated services.

StreamKite provides cloud-based live streaming infrastructure. We are a technical conduit — we transmit the media you upload to the RTMP destinations you specify. We are not a broadcaster, publisher, content network, or media company. We do not create, curate, moderate, or endorse any content streamed through our platform.

This Disclaimer expressly limits StreamKite's liability across six specific high-risk categories that have historically generated disputes in the streaming infrastructure industry: illegal stream usage, refund claims, service downtime, payment processing failures, and platform abuse. Please read each section carefully.

By accessing StreamKite, activating a PassKey, uploading media, or initiating any stream, you confirm that you have read, understood, and unconditionally accepted this Disclaimer. If you disagree with any provision, you must immediately cease using the service and contact our support team.

StreamKite is a technology service, not an insurance policy. We provide infrastructure. What you do with that infrastructure — the content you stream, the platforms you connect to, the audiences you reach — is entirely your responsibility. Our liability in every scenario described in this Disclaimer is explicitly limited and in many cases excluded entirely.

Illegal Streams & User Misuse

StreamKite operates as a neutral transmission infrastructure. We do not pre-screen, filter, or monitor uploaded content before or during streaming. This technical neutrality is both a feature and a legal boundary: it means you bear sole, complete, and unshared legal responsibility for every piece of content you upload and every stream you broadcast through our platform.

🚨 StreamKite Disclaims All Liability For Illegal Content
If you use StreamKite to stream illegal, infringing, harmful, obscene, hateful, fraudulent, defamatory, or otherwise unlawful content, StreamKite bears zero legal or financial responsibility for any consequence that results — including civil lawsuits, regulatory fines, criminal investigations, platform bans, or third-party claims. You are the broadcaster. You are the publisher. You are liable.

Categories of Prohibited Use We Explicitly Disclaim

  • Copyright infringement — streaming music, films, sports, TV, or any copyrighted media without a valid broadcast licence
  • Piracy operations — using StreamKite as infrastructure for illegal IPTV, subscription piracy services, or unauthorised content redistribution
  • Hate speech and incitement — content promoting violence, racial hatred, terrorism, or discrimination of any protected group
  • Fraud and scam content — fake investment streams, phishing broadcasts, impersonation, misleading advertising, or financial fraud
  • Non-consensual content — intimate imagery, doxxing, or content that violates a person's privacy or dignity without consent
  • Illegal gambling or drug promotion — content advertising unlicensed gambling operations or controlled substances
  • Child exploitation material — any content involving the abuse, sexualisation, or exploitation of minors, regardless of format

What Happens When Illegal Content Is Detected

Criminal liability notice: Operating certain types of illegal streams — particularly piracy services, IPTV networks, or fraud broadcasts — may constitute a criminal offence in multiple jurisdictions. StreamKite expressly disclaims all responsibility for criminal prosecution, civil litigation, platform bans, ISP blocks, or regulatory fines that result from your illegal use of our infrastructure. These consequences are yours alone to bear.

Refund Disputes & Payment Limitations

StreamKite operates under a strict prepayment model. When you purchase a plan, your PassKey is generated and your subscription period begins immediately and irrevocably. Because the service is digital, instantaneous, and consumption begins at the moment of activation, refunds are not the default outcome of any dispute.

StreamKite explicitly disclaims any obligation to issue a refund in the following circumstances. These are not edge cases — they represent the most common refund requests we receive, and they are all declined by policy.

Situations Where Refunds Are Categorically Denied

  • Change of mind after purchase or after any period of use — digital services cannot be "returned"
  • Inability to set up a stream due to user error, lack of technical knowledge, or failure to follow our documentation
  • Destination platform issues — if YouTube, Twitch, or Facebook bans your stream key, suspends your account, or refuses your stream, this is not a StreamKite service failure. No refund applies.
  • Unused subscription days — if you stop using the service before your PassKey expires, the unused period is non-refundable
  • Termination for policy violations — accounts terminated for breaching our Terms, DMCA policy, or this Disclaimer are never eligible for refund
  • Failure to renew before expiry — if your subscription lapses and your data is deleted, StreamKite is not liable for that loss
  • Self-inflicted upload failures — corrupted files, wrong format uploads, or accidental media deletion initiated by the user
  • Streaming to incorrect RTMP endpoints entered by the user — StreamKite streams to exactly where you tell it to
  • Internet connectivity issues on your local network, your ISP, or at the destination platform — these are outside StreamKite's infrastructure
  • Subscription purchased during a promotion and then disputed after the promotion ends

Circumstances Where a Refund May Be Considered

  • StreamKite's own infrastructure has been completely inaccessible for more than 72 consecutive hours due to a fault on our side (not third-party providers)
  • A PassKey was delivered that is technically non-functional and our support team is unable to resolve it within 48 hours of a verified report
  • A verifiable duplicate charge occurred — two payments processed for the same plan within the same billing cycle

Chargeback Warning: Filing a payment chargeback or dispute with your bank without first contacting StreamKite support constitutes a breach of our Terms. It may result in your account being permanently banned and your details being flagged across our payment processing network. All legitimate disputes should be raised through our support ticket system first.

Section 04 · SLA & Uptime
Service Downtime & Interruptions

StreamKite targets a 99.9% uptime rate for our streaming infrastructure across all three server nodes. This is an operational commitment and represents our genuine engineering goal. However, it is not a blanket guarantee that entitles you to compensation for every minute of downtime.

StreamKite Explicitly Disclaims Liability For Downtime Caused By

  • Failures of upstream cloud infrastructure, CDN providers, or DNS resolution services used by StreamKite's hosting environment
  • Internet routing failures between StreamKite's servers and destination platforms
  • Regulatory or governmental actions that restrict or block streaming services in specific jurisdictions
  • Cyberattacks including DDoS, ransomware, or infrastructure intrusion attempts targeting StreamKite or its data centre providers
  • Force majeure events including natural disasters, pandemics, civil unrest, or any event beyond reasonable human control
  • Planned maintenance windows, whether or not advance notice was provided
  • Third-party API or RTMP endpoint changes at destination platforms that break stream acceptance
📡 What We Do When Downtime Occurs

When a downtime event on StreamKite's infrastructure is confirmed, our engineering team works to restore service as quickly as possible. For outages exceeding 4 hours caused by a verifiable fault on our infrastructure, affected users may be eligible for a proportional extension of their subscription at our discretion. We do not automatically issue credits or refunds for outage periods unless explicitly agreed in writing.

Our Stream engine process management system is designed to detect stream crashes and auto-restart within seconds. The vast majority of stream interruptions are recovered automatically without any user action. Interruptions shorter than 60 seconds are considered within normal operational tolerance and are not eligible for any form of credit or compensation.

Section 05 · Commercial
Payment Issues & Processing Disclaimers

All payments for StreamKite plans are processed by third-party payment processors (including but not limited to Payhip, Stripe, and PayPal). StreamKite does not directly process, store, or handle your payment card details at any point. Your card data is transmitted exclusively to and handled exclusively by the payment processor's secure infrastructure.

💳 StreamKite Disclaims Responsibility For

All payment errors, processing failures, currency conversion discrepancies, declined transactions, double charges, or security incidents that occur at the payment processor level. These are governed exclusively by the payment processor's own terms of service and privacy policy — not StreamKite's.

Specific Payment Disclaimer Provisions

  • Failed transactions: If your payment fails at checkout, no PassKey is issued and no service begins. StreamKite is not responsible for failed bank authorisations, expired cards, or payment processor downtime.
  • Currency conversion: Prices are listed in USD. If your bank or card issuer applies currency conversion fees, foreign transaction fees, or converts at unfavourable rates, StreamKite is not responsible for the difference.
  • VAT and local taxes: Depending on your jurisdiction, value-added tax or local sales tax may be applied by the payment processor at checkout. StreamKite is not responsible for tax obligations in your country.
  • Double charges: If you believe you were charged twice for the same plan, contact our support team within 7 days with transaction evidence. We will investigate and if confirmed, credit your account or issue a refund for the duplicate charge only.
  • Promotional codes: If a promotional price was not applied correctly at checkout, you must raise this before completing payment. StreamKite will not retroactively apply promotions to completed transactions.
  • Payhip and third-party storefronts: Purchases made through our reseller or affiliate storefronts are also subject to the refund and payment policies of those platforms. StreamKite disclaims responsibility for any dispute between you and a third-party storefront operator.

Chargeback abuse: Using your bank's chargeback mechanism as a refund tool — rather than following StreamKite's legitimate dispute process — is considered payment fraud under our Terms. It will result in immediate permanent account termination and may be reported to the payment processor's fraud prevention system. This could affect your ability to use that payment method on other platforms.

The correct process for any payment concern is always: contact StreamKite support first. We resolve legitimate payment issues quickly and fairly. Most payment queries are resolved within 48 hours.

Section 06 · Zero Tolerance
Platform Abuse & Infrastructure Misuse

StreamKite's infrastructure is shared across multiple users and multiple server nodes. Any action that degrades performance, compromises security, or attempts to exploit the platform is a direct attack on every other legitimate user on the platform. We treat platform abuse with the same severity as illegal content violations.

Defined Acts of Platform Abuse

  • Server resource exhaustion — deliberately streaming at excessively high bitrates, uploading corrupt media in loops, or initiating processes designed to monopolise CPU or bandwidth
  • Dashboard automation attacks — using bots, scripts, or automated tools to spam the dashboard, API endpoints, or upload system beyond normal use patterns
  • PassKey farming or reselling — purchasing multiple plans to resell PassKey access as a commercial service without StreamKite's express written authorisation
  • Security probing — attempting to discover vulnerabilities, exploit server configurations, access other users' data, or probe our network infrastructure
  • Intentional interference — any action designed to degrade the experience of other StreamKite users or destabilise shared server infrastructure
  • Credential stuffing — attempting to gain unauthorised access to other users' PassKeys or accounts
  • Fraudulent ticket spam — submitting bad-faith support tickets designed to consume support resources, intimidate support staff, or manufacture false evidence of service failures
  • False DMCA abuse — filing knowingly false DMCA takedown notices against other StreamKite users as a harassment tactic
🛡️ Zero Tolerance Enforcement
Platform abuse results in immediate permanent account termination without warning, without refund, and without appeal. Where abuse constitutes a criminal offence under applicable computer crime law (including but not limited to the Computer Fraud and Abuse Act, the UK Computer Misuse Act, or equivalent legislation), StreamKite reserves the right to report the incident to relevant law enforcement authorities and pursue civil damages for any losses we or our users suffer as a result of the abuse.

Reseller clarification: Offering client streaming services using your own StreamKite PassKey and slot allocation is permitted — this is a common and legitimate use case. What is not permitted is purchasing StreamKite plans and reselling the PassKey credentials directly to third parties as if they were the account holder, without StreamKite's knowledge or authorisation. The distinction is: managing streams for clients (✓ acceptable) vs. selling access to our authentication system (✕ abuse).

Third-Party Platform Disclaimer

StreamKite connects to and transmits streams to third-party platforms including YouTube, Twitch, Facebook Live, TikTok, Instagram, Rumble, Kick, and any custom RTMP endpoint you configure. StreamKite has no affiliation with, authority over, or contractual relationship with any of these platforms on your behalf.

StreamKite Disclaims All Responsibility For

  • Destination platforms revoking, expiring, or invalidating your stream key without notice
  • Platforms changing their RTMP endpoint URLs, stream key formats, or authentication requirements in ways that break your stream
  • Platform-imposed streaming restrictions including simultaneous stream limits, viewer count limits, or geographic blocks
  • Content strikes, channel suspensions, demonetisations, or account bans applied by destination platforms
  • Platform outages that prevent your stream from being received or displayed to viewers
  • Algorithmic changes that affect the reach, discoverability, or visibility of your stream on any platform
  • Platform policy changes that render certain types of content unacceptable on their service
  • Viewer-reported issues — latency, buffering, quality — experienced on the destination platform's player or CDN

If a third-party platform takes action against your stream or account, the appropriate response is to contact that platform directly. StreamKite cannot intervene in, appeal, or otherwise interact with third-party platform moderation decisions.

Nothing published on StreamKite.live — including this Disclaimer, our Terms, our FAQ, our blog, our support ticket responses, or any communication from StreamKite staff — constitutes legal advice, tax advice, financial advice, copyright counsel, or any form of professional advice.

  • Legal questions — "Can I stream this music?" is a legal question. Our support team cannot answer it authoritatively. Consult a qualified intellectual property lawyer.
  • Tax questions — whether your streaming income is taxable and how much you owe varies by jurisdiction. StreamKite does not provide tax guidance. Consult a qualified accountant.
  • Financial questions — whether investing in streaming equipment, services, or a StreamKite plan is the right financial decision for your situation is not something we can determine for you.
  • Platform compliance questions — whether your proposed stream content complies with YouTube, Twitch, or Facebook policies should be verified directly with those platforms.

Any statement made by a support agent that appears to constitute legal or professional advice is made informally and without legal authority. However, we make no warranties of any kind regarding the completeness, accuracy, reliability, or timeliness of any information on StreamKite.live.

  • Pricing — prices displayed are subject to change. The price at the moment of checkout is the binding price.
  • Feature descriptions — we continuously develop and update the platform. Features described may be modified, removed, or replaced without notice.
  • Uptime statistics — historical uptime figures are averages and do not guarantee future performance.
  • Platform compatibility — third-party platforms change their streaming specifications. StreamKite cannot guarantee perpetual compatibility with every platform.
  • External links — our website may link to third-party resources. StreamKite does not endorse or accept responsibility for the content or accuracy of linked external sites.

Section 10 · Liability Cap
Consequential & Indirect Damages

To the maximum extent permitted by applicable law, StreamKite and its affiliates, directors, employees, agents, and service providers shall not be liable for any consequential, indirect, incidental, punitive, or special damages of any kind, including but not limited to:

  • Loss of income, revenue, or profits arising from stream downtime or service interruption
  • Loss of audience, subscribers, followers, or monetisation opportunities
  • Loss of sponsorship, partnership, or advertising revenue linked to streaming performance
  • Reputational damage arising from stream quality issues, downtime, or content complaints
  • Costs of purchasing alternative streaming services during any period of downtime
  • Loss of business contracts or commercial opportunities dependent on streaming operations
  • Data loss including uploaded media files, stream configurations, or analytics data
  • Emotional distress, loss of enjoyment, or non-economic harm of any kind

These exclusions apply regardless of the legal theory under which the claim is brought (contract, tort, negligence, strict liability, or otherwise) and even if StreamKite was advised of the possibility of such damages in advance.

⚖️ Maximum Liability Cap

In every scenario, StreamKite's total maximum liability to you shall not exceed the total amount you paid to StreamKite in the thirty (30) calendar days immediately preceding the event giving rise to the claim. This cap applies in aggregate across all claims, actions, and theories of liability combined.

Your Indemnification Obligation

By using StreamKite, you agree to indemnify, defend, and hold harmless StreamKite, its officers, directors, employees, contractors, agents, licensors, and service providers from and against any and all third-party claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Any content you upload, store, or stream through the StreamKite platform
  • Your violation of these disclaimers, our Terms, or any other StreamKite policy
  • Your violation of any applicable law, regulation, or third-party rights
  • Your use or misuse of the StreamKite platform, PassKey, or infrastructure in any way
  • Any claim by a third party that your content caused them harm, violated their rights, or constituted infringement
  • Your unauthorised use of third-party intellectual property through our platform
  • Any regulatory investigation, fine, or enforcement action resulting from your streaming activities

This indemnification obligation survives the termination of your StreamKite subscription for the full period permitted under applicable statute of limitations law. StreamKite reserves the right to assume exclusive control of its defence in any matter covered by this indemnification, at your expense.

In plain language: if your use of StreamKite gets StreamKite sued, fined, or investigated, you pay for StreamKite's defence. This is a standard provision in service agreements of this nature and is designed to protect our ability to continue operating as a platform for the many legitimate creators we serve.

Your Acceptance & How to Contact Us

By using StreamKite in any capacity — browsing the website, purchasing a plan, activating a PassKey, uploading media, or initiating a stream — you confirm that you have read this Disclaimer in full and agree to be bound by every provision it contains. This acceptance is legally binding and constitutes part of your agreement with StreamKite.

StreamKite reserves the right to update this Disclaimer at any time. Material changes will be signalled by an updated "Effective Date" at the top of this document. Continued use of the service after any update constitutes acceptance of the revised Disclaimer.
